Tampa Divorce Laws

At the Davis Law Group, P.A., we understand that divorce can be difficult for everyone involved. Our attorneys handle each and every case with the compassion and care needed so that your divorce goes as smoothly as possible.

If you are considering a Tampa divorce, it is important to have a divorce lawyer with expert knowledge in regards to Florida divorce laws. Our divorce lawyers, Scott Paul Davis and Kendra R. Davis, are both Florida Supreme Court Certified Family Law Mediators with years of experience under their belt. They will do everything they can to help you legally dissolve your marriage in a fair and amicable manner, and will fight on your behalf to protect your rights and property in court if necessary.

The divorce process

Below are the steps involved in filing a Tampa divorce:

  • Establishing residency requirements: Divorcing in Tampa requires that you first meet Florida residency requirements. These requirements state that one of the spouses must reside in the state for six months before filing the petition.
  • Grounds for filing: The appropriate grounds for filing must be declared. In Florida, the dissolution of marriage grounds are either the marriage is irretrievably broken or mental incapacity of one of the parties for a period of three years.
  • Forms & petition: Fill out the appropriate forms and file your petition with the appropriate Circuit Court. Unfortunately, there are many forms, so having an experienced divorce attorney can help make this process less stressful and time consuming.
  • Time: If your divorce is non-contested, meaning both parties agree on all of the terms, the divorce may be granted 31 days after the initial filing. However, when the divorce is contested it generally takes much longer because of issues with property division, alimony, child support, and litigation.
