Tampa Uncontested Divorce
An uncontested divorce is often the best option when spouses who wish to divorce can agree on all issues. Uncontested divorce offers a faster, less expensive, and less complicated alternative to the often long, drawn-out, and expensive legal battle of a contested divorce.
Key questions to ask yourself when assessing if a Tampa uncontested divorce is the right option to end your marriage may include the following:
- Are you and your spouse in agreement that the marriage is irretrievably broken?
- Are you and your spouse able to effectively and openly communicate with one another?
- Do you and your spouse agree on the distribution of property, assets, and liabilities?
- If there are children involved, is there agreement about child custody and visitation arrangements? what about support payments?
- Is there agreement on details of spousal support (alimony)?
Dissolution of marriage in Florida also requires couples to adhere to residency requirements regardless of the type of divorce pursued. At least one spouse must live in Florida for six months before a divorce petition can be filed. The petition can then be filed in either of the counties where the spouses live.
The uncontested divorce process
Either spouse must file a Petition for Dissolution of Marriage with the local county court to begin a Tampa uncontested divorce. Because Florida is a no fault state, the only reason needed for the end of the marriage is that it is irretrievably broken. Both spouses must also sign a Marital Settlement Agreement that is filed along with the petition. The agreement spells out all the details regarding children, alimony payments, property division, and assets and debts.
A hearing for final judgment is scheduled once all paperwork is filed. The hearing is ususally very brief and it is not always necessary for both spouses to be present for an uncontested divorce. The entire process may take as little as 30 to 60 days depending on the case.
