How do I show the court that my divorce is no one’s fault?

Florida is a no-fault divorce state which means that the courts grant divorces based on irreconcilable differences

What do I need to know to protect my children during a divorce?

Florida family courts make decisions about child-rearing matters in a divorce based on the best interests of the child.  The judge looks at many factors that include the emotional bonds between each parent and the child, the demonstrated capacity and disposition of each parent to facilitate timesharing with the other parent, the overall stability of one household over another, and several other factors.

What do I do if my circumstances change and I cannot afford my alimony or child support?

You may be able to file for a modification based on a material change of circumstances.  The Davis Law Group, P.A. can advise if you meet the criteria for this.

Will the court let me keep my house even if I don’t make enough money for the mortgage or taxes?  I don’t earn enough to move elsewhere alone, either. 

Each divorce is unique, but if you gave up your own opportunities in the service of your family, you may be able to remain in your home, while your ex-spouse makes alimony payments to you.  Other solutions may involve your ex-spouse paying for separate housing for you or making an alimony payment in an amount that lets you move somewhere else.

This is a fairly common situation for spouses in high-asset divorces where one spouse stayed home in support of the career ambitions of the other, and we can help.

I used to earn a lot of money, but now that the economy is so weak, I don’t.  Do I need to worry that my tax returns mean I’m going to pay a lot of alimony?

This is something we need to consider when we plan your divorce, but your tax returns are not the only factor in the amount of alimony you pay.  Florida courts look at several aspects of a marriage when determining alimony or other property-division matters

Can I try out being divorced with a separation agreement?
