How the Bail Process Works

The first steps

When the defendant contacts you, make sure he or she tells you exactly how much bail is required and if the court requests a certain type of payment.  The judge may request cash in some cases and you need to prepare for this.  The courts usually do not accept personal checks or debit cards.

If your loved one’s case requires cash, the court will release him or her into your custody after you produce the amount demanded.  The court will return your money when the defendant appears in court.

Using a bail bondsman

However, if the bail is beyond your financial means, you can inquire into using the services of a bail bondsman.  The booking officer of the court may be able to recommend local bail bond companies.  You can also use the phone book or the Internet.  Bail bondsmen often require the following to help you:

  • Ten percent of the bail non-refundable fee
  • Information on your relationship with the defendant
  • Information about the defendant, including his or her living arrangement, employment, and other details
  • Police and arrest reports

If the bond company believes your loved one is a flight risk or may not appear in court, the company may refuse to help you unless you put up personal property or other assets for collateral.  You will lose your property if the defendant does not appear at his or her required court dates.
